Applications for Unemployment Benefits Rose Sharply ... - Bankruptcy

The number of U.S. citizens asking for unemployment benefits rose significantly last week, although the rise may have been aided by seasonal factors, according to a report from USA Today.

Last week, applications for unemployment aid rose by 8,000 to a total of 365,000, according to a Labor Department report. The four-week average, however, fell to 365,500, which is the lowest mark since the end of March.

Despite the drop in the four-week average, however, last week?s unemployment figures portrayed an economy that still remains perilous for job seekers.

Rise Unemployment Benefits Reflects Stagnant Economy

While national filings for personal bankruptcy have been on the decline, as consumers tighten their grip on their wallets, the employment figures continue to make economists concerned.

In the first three months of 2012, the country added an average of 226,000 jobs in the private and public sectors, which made economists cautiously optimistic that a full economic recovery was on the horizon.

However, from April to June, the workplace only added an average of 75,000 new jobs. This figure is nothing to sneeze at, but it certainly reflects a significant slowdown in the creation of new jobs.

In July, sources estimate that employers added about 100,000 new jobs, which is a sign of some progress, but it wouldn?t shift the employment rate from its current position at 8.2 percent.

Unemployment Rate Remains Stuck in Neutral

Sources indicate that the economy simply isn?t growing fast enough to lower the unemployment rate. Thus, while the economy continues to add some jobs, it cannot keep pace with the number of new workers entering the job market every month.

And the dismal economic news extends beyond the job market. Sources say that orders to factories fell by a half of a percent last month, which was the third such decline in the last four months.

In addition to the declining factory activity, orders for ?core capital goods,? which is considered a reliable indicator for business investment, dropped by 1.7 percent. Much of this decline was due to decreased demand for computers and heavy machinery.

The manufacturing figures are especially troubling because, since the recession officially ended in the summer of 2009, the manufacturing sector has been an important source of growth for the American economy.

So, the drop in factory orders, combined with the modest employment figures, suggests that the economy might not pick up speed for several months, which could make for a very interesting election cycle this fall.

Federal court rejects Texas voter ID law

U.S. Attorney General Eric Holder told the NAACP annual convention on July 10 in Houston that he opposes a new photo ID requirement in Texas elections because it would be harmful to minority voters.

Updated at 2:42 p.m. ET: A federal court in Washington on Thursday blocked a Texas law that would require voters to present photo IDs to election officials before being allowed to cast ballots in November, saying it would place an unfair burden on minorities and the poor.

A three-judge U.S. District Court panel ruled that that SB 14, described as the most stringent voter ID law in the country, imposes "strict, unforgiving burdens on the poor" and noted that racial minorities in Texas are more likely to live in poverty.

?Texas, seeking to implement its voter ID law, bears the burden of proof and must therefore show that SB 14 lacks retrogressive effect. But as we have found, everything Texas has submitted as affirmative evidence is unpersuasive, invalid, or both,? the opinion said.


The Justice Department blocked the new Texas ID law in March, and now a federal court in Washington has done the same, saying it would hit minority voters especially hard. NBC's Pete Williams reports.

?Moreover, uncontested record evidence conclusively shows that the implicit costs of obtaining SB 14-qualifying ID will fall most heavily on the poor and that a disproportionately high percentage of African Americans and Hispanics in Texas live in poverty. We therefore conclude that SB 14 is likely to lead to ?retrogression in the position of racial minorities with respect to their effective exercise of the electoral franchise.??

The ruling was the second legal blow to Texas this week. On Tuesday, another federal court panel threw out a Texas redistricting plan, finding evidence of discrimination in voting maps drawn by the state's Republican-controlled Legislature.

The decision on the voter ID law involves an increasingly contentious political issue: a push, largely by Republican-controlled legislatures and governor's offices to impose strict identification requirements on voters.

Republicans are aggressively seeking the requirements in the name of stamping out voter fraud. Democrats, with support from a number of studies, say that fraud at the polls is largely non-existent and that Republicans are simply trying to disenfranchise minorities, poor people and college students -- all groups that tend to back Democrats.

Who can vote?: Special series on voter ID issues

The ruling comes in the same week that South Carolina's strict photo ID law is on trial in front of another three-judge panel in the same federal courthouse. A court ruling in the South Carolina case is expected in time for the November election.

Texas Gov. Rick Perry signed SB 14 into law on May 27, 2011. The law has yet to take effect because the state needs ?preclearance? for any change in voting procedures from either the U.S. attorney general or a three-judge U.S. District Court panel.

The judges said such voter ID laws might well be approved if they ensure that all prospective voters can easily obtain free photo IDs, and that any underlying documents required to obtain that ID are truly free of charge.

But the judges noted the Texas Legislature tabled or defeated amendments that would have, among other things, waived all fees for indigent persons who needed the underlying ?documents and reimbursed poor people for ID-related travel costs.

In the Texas case, the Justice Department called several lawmakers, all of them Democrats, who said they detected a clear racial motive in the push for the voter ID law. Lawyers for Texas argued that the state was simply tightening its laws. Texas called experts who demonstrated that voter ID laws had a minimal effect on turnout. Republican lawmakers testified that the legislation was the result of a popular demand for more election protections.

During an appearance at the NAACP convention in in Houston in July, Attorney General Eric Holder said Texas' photo ID requirement amounts to a poll tax, a term that harkens back to the days after Civil War Reconstruction when blacks across the South were stripped of their right to vote. The attorney general told the NAACP that many Texas voters seeking to cast ballots would struggle to pay for the documents they might need to obtain the required photo ID.

In a statement Thursday, Holder said he was pleased by the court's action.??The court?s decision today and the decision earlier this week on the Texas redistricting plans not only reaffirm -- but help protect -- the vital role the Voting Rights Act plays in our society to ensure that every American has the right to vote and to have that vote counted," he said.

White House spokesman Jay Carney said the Texas law does not comply with the landmark Voting Rights Act of 1965, which?outlawed discriminatory voting practices blamed for the widespread disenfranchisement of blacks. "As you know this administration believes it should be easier for elligible citizens to vote, to register and vote. ?We should not be imposing unnecessary obstacles or barriers to voter participation," Carney said.

Texas Attorney General Greg Abbott said the state will appeal the panel's rejection to the U.S. Supreme Court.

?The Supreme Court of the United States has already upheld voter ID laws as a constitutional method of ensuring integrity at the ballot box,? he said in a statement. ?Today's decision is wrong on the law and improperly prevents Texas from implementing the same type of ballot integrity safeguards that are employed by Georgia and Indiana - and were upheld by the Supreme Court. The State will appeal this decision to the U.S. Supreme Court, where we are confident we will prevail."

Russian arrested in killing denies Pussy Riot ties

MOSCOW (AP) ? Investigators say police have detained a man who has confessed to killing two women in a central Russian city, and then tried to mislead investigations by scrawling a message at the murder scene demanding freedom for jailed members of the Pussy Riot band.

The man ? a 38-year-old university professor named Igor Danilevsky ? was detained Thursday in Kazan, Russia's Investigative Committee said on Friday. It said Danilevsky wrote "Free Pussy Riot" on a wall in the victims' blood because he wanted the deaths of the 38-year-old woman he dated and her mother, 76, to appear as if they were a "ritual killing."

The Committee said Danilevsky had convinced the woman to take out a loan to repay his debts, and promised to marry her. Police had found the knife used to stab the women to death and disfigure their faces and bodies, it said.

Three members of the band were sentenced to two years in prison earlier this month for a February "punk prayer" in Moscow's main cathedral entreating the Virgin Mary to save Russia from Vladimir Putin, who at the time was on the verge of winning a third term as Russian president.

The trial, widely seen as Kremlin-orchestrated, caused an international furor, with celebrities such as Paul McCartney urging Russian authorities to free the band.

The jailed band members' attorney had called the two women's murder "either a horrendous provocation or a psychopathic" case.

Kremlin-friendly media and Orthodox Church clerics had seized upon the alleged link between the murder and the band to lambast the artists and their supporters, and compared them to mass murderer Charles Manson, whose followers used the blood of victims to write on the walls of their houses.

Some Russian publications ran headlines claiming Pussy Riot supporters "committed" or "inspired" the double homicide. The coverage was full of the mostly negative terms used by Kremlin-friendly television networks and media in their coverage of the protesters' trial.

The Orthodox Church has called the band's stunt sacrilegious, but hundreds of artists, musicians and other intellectuals have signed petitions urging authorities to free them.

(AP) ? Tyler Hamilton says Lance Armstrong gave him an illegal blood booster before the 1999 Tour de France and that the teammates took blood transfusions together during the cycling race the following year.

Hamilton makes the allegations in his book, "The Secret Race. Inside the Hidden World of the Tour de France, Doping, Cover-ups and Winning at All Costs," set to be published Sept. 5. The Associated Press purchased a copy Thursday.

Hamilton and Armstrong rode together on the U.S. Postal Service team from 1998 to 2001.

Armstrong has long denied doping but last week chose not to fight drug charges by the U.S. Anti-Doping Agency. USADA has erased 14 years of Armstrong's competitive results, including his seven Tour de France titles.

The books covers much of what Hamilton said in a 2011 interview with "60 Minutes" and what he said he told federal criminal investigators looking into doping allegations on the Postal team. Officials closed that investigation in February without bringing any charges against Armstrong.

But Hamilton also provides sharper, personal details of what he says was an alleged doping program encouraged by Armstrong and other team leaders. He describes in detail how he and other cyclists doped and how they avoided getting caught.

"Lance worked the system ... Lance was the system," Hamilton wrote.

Armstrong's agent Bill Stapleton declined comment when contacted by phone.

Hamilton discusses at length his own descent into performance-enhancing drug use and said the team started even before Armstrong joined in 1998. He and Armstrong soon became roommates and confidants who would discuss using the blood-booster EPO and other PEDs.

"Nobody sets out wanting to dope," Hamilton said.

While visiting Armstrong's home in Nice shortly before the 1999 Tour, Hamilton said he asked him if he had any EPO and Armstrong pointed to the refrigerator. Hamilton took it, thanked Armstrong and remarked to himself how cavalier Armstrong was about simply keeping it in the refrigerator.

Hamilton described a doping plan put in place by the team for the 1999 Tour de France, with Armstrong's knowledge, that included a motorcyclist riding behind racers with a thermos full of EPO. It was to be dispensed to riders in the team camper after race stages.

He said team leaders, doctors and mangers encouraged and supervised doping and PEDs were handed out to cyclists in white lunch bags.

Hamilton said he and Armstrong sat near each other to take a blood transfusion after the 11th stage of the 2000 Tour de France, under the watchful eye of team director Johan Bruyneel. That would have been right before the Tour's punishing and famous Ventoux mountain stage.

Bruyneel is also facing doping charges by USADA and a lifetime ban if found guilty of leading what the agency has referred to as a vast doping conspiracy on his teams. Bruyneel has taken his case to arbitration.

Hamilton also renewed his claims that Armstrong told him he tested positive for EPO at the 2001 Tour of Switzerland but was able to get the International Cycling Union to cover it up. The UCI, cycling's governing body, has denied Hamilton's claim.

Armstrong argues that hundreds of negative drug tests prove his claims of innocence. He has previously sought to discredit Hamilton as a drug cheat who was twice banned for doping and was recently stripped of his 2004 Olympic gold medal.

According to USADA, Hamilton is among its key witnesses ready to testify against Armstrong. In all, it said as many as 10 former teammates were ready to do so. The agency has withheld most of their names, saying it feared Armstrong would try to intimidate them.

Hamilton alleged that former Postal rider George Hincapie, a key Armstrong lieutenant during his seven Tour victories, also was given PEDs while he rode for the team.along with rider Kevin Livingston.

Hincapie was among several riders reported to be ready to testify against Armstrong.

There was no immediate response to an email seeking comment from Hincapie's management team. Nor was there a response to a telephone message left at Livingston's athletic training business.

Stanford, San Jose State set to open football season

Season openers often bring the unexpected as teams work off the rust and work through the glitches. When both participants start rookie quarterbacks, as will be the case Friday when San Jose State visits No. 21 Stanford, the potential for mayhem soars.

The latest installment of the "Bill Walsh Legacy Game" could feature fumbled snaps, a pick-six, perhaps a dazzling touchdown pass or two.

And just think what might transpire in the second quarter.

"I feel good about 90 percent of what we're putting on the field," Cardinal coach David Shaw said. "We'll see about the other 10 percent."

San Jose State coach Mike MacIntyre echoed the sentiment, although he stopped short of attaching percentages. Neither coach named names, or positions, but the quarterbacks could figure prominently into the uncertainty.

Stanford's Josh Nunes and SJSU's David Fales aren't merely first-time starters -- they are essentially first-time players. Nunes has thrown two career passes; Fales hasn't thrown any at the major-college level, having transferred to SJSU from Monterey Peninsula College.

"I'm not nervous," Nunes said Monday. "But maybe a few butterflies will show up later in the week."

For both Nunes and Fales, the mission is the same: make sound decisions, complete enough passes to keep the defense honest and, above all, avoid turnovers. But their success in those vital areas will be based, to a large extent, on the respective running

games.

If Stanford tailback Stepfan Taylor churns for 5 or 6 yards per carry, for example, Nunes should have a relatively pressure-free evening. SJSU's defense won't know what is coming or when it is coming and will have to blitz judiciously.

"What makes them go is their offensive line," MacIntyre said. "It blows open holes even I could run through."

At the same time, if SJSU's tailbacks are stuffed at the line of scrimmage, Fales will face long-yardage situations against Stanford's relentless pass rush.

In last season's meeting between these teams, the Spartans rushed for 27 yards, lost three fumbles and fell 57-3. Stanford started six possessions in SJSU territory and converted the opportunities into 31 points.

"They return a lot of players that played last year, so we know they're good," Fales said.

But past success isn't necessarily indicative of what will unfold Friday -- even when it comes to Stanford's vaunted running game.

The Cardinal is replacing two of the best offensive linemen in school history (guard David DeCastro and tackle Jonathan Martin); it plans to use true freshmen in the rotation up front (tackles Andrus Peat and Kyle Murphy); and it probably won't have injured fullback Ryan Hewitt, one of its most valuable players.

So maybe Stanford will have a tough time running the ball, allowing SJSU's blitzers to rattle Nunes and setting the stage for a taut finish.

Or maybe it will be 58-3.

"You never know how it will unfold," MacIntyre said. "Sometimes, an uncertainty can become your strength."

Twitter data crunching: The new crystal ball

ScienceDaily (Aug. 29, 2012) ? Fabio Ciulla from Northeastern University, Boston, USA, and his colleagues demonstrated that the elimination of contestants in TV talent shows based on public voting, such as American Idol, can be anticipated. They unveiled the predictive power of microblogging Twitter signals--used as a proxy for the general preference of an audience--in a study recently published in EPJ Data Science.

The authors considered the voting system of these shows as a basic test to assess the predictive power of Twitter signals. They relied on the overlap between Twitter users and show audience to collect extremely detailed data on social behaviour on a massive scale. This approach provided a unique and unprecedented opportunity to apply network science to social media. Social phenomena can thus be studied in a completely unobtrusive way. Previously, Twitter has already been used to forecast epidemics spreading, stock market behaviour and election outcomes with varying degrees of success.

In this study, the authors demonstrated that the Twitter activity during the time span limited to the TV show airing and the voting period following it correlated with the contestants' ranking. As a result, it helped predict the outcome of the votes. This approach offers a simplified version helping to analyse complex societal phenomena such as political elections. Unlike previous voting systems, Twitter offers a quantitative indicator that can act as proxy for what is occurring around the world in real time, thereby anticipating the outcome of future events based on opinions.

Ciulla and colleagues also showed that the fraction of tweets that included geolocalisation information enabled to internationally map the fan base of each contestant. They identified a strong influence by the geographical origin of the votes, suggesting a different outcome to the show, if voting had not been limited to US voters.

Lu Bird Baby: Baby Caleb's shower

Last weekend we had the pleasure of throwing his baby shower for my best friend Anna as they prepare for his arrival home!

Caleb's little life has been so amazing to watch.?

He's only 4 (almost 5) months old and God has already used Him mightily for His glory.

Caleb is proof that God is the Creator and Sustainer of life

and that He is full of mercy and grace.

What a great God we serve!

Here are a few details from the shower.

One of our friends made the cute "Mighty Mouse" onesie to represent Caleb's nickname in the NICU (the doctors called him mighty mouse because he was tiny but strong) and we decorated the mantle with some fabric bunting and pictures of Caleb over the past 4 months.?

The backyard was also decorated for the occasion but since it was sooooo hot we pretty much stayed indoors.?

We asked each guest to write a little note to Anna or baby Caleb and then a few of us shared them during the shower.?

It comes in handy to know a baker.?

One of our friends made the most delicious lemon cupcakes ever.?

Seriously I could have ate them all.

Oh and I totally forgot to take pictures of the rest of the food but we had lots of yummy brunch things...egg casserole, potatoes, french toast casserole, muffins, fruit, croissants, etc.

We also played a couple simple baby games.?

Because what's a baby shower without games.

And the best part of any shower...presents!!!

Anna finally got some BLUE in her life with tons of cute boy stuff (she also has two girls at home so they are overwhelmed with pink right now).?

It was so fun to be celebrating Anna and baby Caleb and we are all counting down the days until he is home.?

Sony has announced a whole flock of new products at the IFA tech?trade show in Berlin. Practically every line of consumer electronics was refreshed during the hour-long press conference, from mobile phones and tablets to cameras and TVs. Here's the short version:

The biggest announcement, at least physically, would be an enormous, new super-high-definition TV. The XBR-84X9005 is an expansive 84 inches diagonally, with a resolution of 3,840-by-2,160 ? twice as many pixels in both directions as a 1080p set. Of course it supports 3-D and?has?all the usual smart-TV features. It should be available this year, and while pricing wasn't discussed, it will probably be extremely expensive.

Lastly, there's?a pair of cameras. The NEX-5R is an update to its mirrorless interchangeable lens line that adds better?autofocus and some handling improvements. You can also run optional "apps" downloadable from a Sony app store. Then there's the Action Cam, a small 1080p camera like those from GoPro and Contour that clips onto helmets and surfboards and the like, capturing wide-angle footage that you can review through a smartphone app.

Most of the devices should be available in the next few months, but as IFA is a European show, differences in each country's pricing and schedule prevent Sony getting too specific. A?U.S. release of these devices is likely not far behind, and pricing will be announced closer to that time.

Blunt Christie tells Republicans it's time to face fiscal truth

TAMPA, Florida (Reuters) - New Jersey Governor Chris Christie accused Democrats of refusing to tell Americans the truth about the depth of the country's deep fiscal woes on Tuesday in a pugnacious keynote speech in support of Republican presidential nominee Mitt Romney.

Christie delivered the main speech of the evening at the Republican National Convention. The rotund, combative governor drew sustained applause from the thousands of delegates who gathered to formally nominate Romney as their candidate to face Democratic President Barack Obama in the November 6 election.

Christie, a popular surrogate for Romney who had been on his short list of potential vice presidential running mates, had tough words for Obama and other Democrats.

"They believe that the American people don't want to hear the truth about the extent of our fiscal difficulties ... and need to be coddled by big government," Christie said. "They believe the American people are content to live the lie with them."

Christie, known in part for seeking to curb government spending by reducing the influence of teachers' unions in New Jersey, joined other Republicans in calling for an overhaul of federal entitlement programs such as Medicare, the health insurance plan for seniors, that are driving much of America's debt problem.

Democrats have attacked Romney's vice presidential running mate, Paul Ryan, for proposing a plan in the U.S. Congress to change Medicare, the government health insurance plan for seniors, for Americans under age 55 in order to save money.

"Tonight, our duty is to tell the American people the truth," said Christie, whose effectiveness as an economic messenger has been undercut recently by a slumping New Jersey economy that has shed jobs and now has the fourth-highest unemployment rate among U.S. states - which at 9.8 percent tops the national average of 8.3 percent.

"Our problems are big and the solutions will not be painless," Christie said. "We all must share in the sacrifice. Any leader that tells us differently is simply not telling the truth."

Christie suggested that Obama is more interested in being popular than in making tough decisions.

"There's only one thing missing now: leadership. It takes leadership that you don't get from reading a poll," he said. "You see, Mr. President, real leaders don't follow polls. Real leaders change polls." (Editing by David Lindsey and Leslie Adler)

Oil price falls as crude supply rises

Oil prices fell Wednesday as U.S. supplies of crude rose for the first time in a month and finance ministers from industrialized nations pleaded with top producers to help lower crude prices and help the global economy.

Traders also watched for any reports of significant damage from Hurricane Isaac as it passed over oil facilities in the Gulf of Mexico. Nearly 95 percent of Gulf production was halted because of the storm.

Benchmark oil fell 84 cents to finish at $95.49 per barrel in New York. Brent crude, which is used to price international varieties of oil, fell 4 cents to $112.54 per barrel in London.

The government reported that the nation's crude inventories increased by 3.8 million barrels to 364.5 million barrels last week. Analysts had expected a drop of 2 million barrels, according to Platts, the energy information arm of McGraw-Hill.

Separately, finance ministers from the Group of Seven countries said they are concerned that higher oil prices pose a risk to the sluggish global economy. They appealed to oil-producing countries to increase output to help lower prices. The higher price of oil has contributed to a 14 percent increase in U.S. gasoline prices.

Nigel Gault, chief U.S. economist at IHS Global Insight, said "rising gasoline prices, at least temporarily exacerbated by Hurricane Isaac," was among a number of factors that could suppress third-quarter U.S. economic growth, which he estimates at 1.5 percent to 2 percent.

The G-7 ministers also suggested they could ask the International Energy Agency to release oil from strategic reserves to suppress crude prices. The G-7 includes the U.S., Japan, Germany, France, Britain, Italy and Canada. The IEA represents more than two dozen oil-importing nations.

Maria van der Hoeven, who heads the IEA, told Bloomberg News that there is no need for a release from its stockpiles. "The market is sufficiently well supplied," she said in an interview in Stavanger, Norway, adding that any action would require "a serious disruption of supply."

The price of oil has risen by more than 20 percent since late June. But both benchmark U.S. oil and Brent crude remain more than 10 percent below their highs for the year.

Meanwhile, Hurricane Isaac pushed inland after battering the Gulf Coast, but it could be days before the extent of any damage to oil production facilities and coastal refineries is known.

Early reports indicated some rigs that were moved ahead of the storm were accounted for and all mobile drilling units remained in position, according to the Bureau of Safety and Environmental Enforcement.

Royal Dutch Shell plans to conduct a flyover inspection of its Gulf operations on Thursday as the weather improves. If conditions prove safe, it will deploy staff Friday to begin restarting operations. ExxonMobil said it's beginning to assess Isaac's impact on its operations in and around the Gulf as well.

About 1.3 million barrels per day of oil production has been shut down because of the Gulf closures. Some of that impact has been softened by changes in the market and the facilities themselves over the past few years.

Technological advances have led to a jump in oil production from onshore operations since hurricanes last hit the Gulf in 2008. And rigs have been constructed to be more durable after previous hurricanes.

"The storm wasn't strong enough to probably do any serious infrastructure damage," said Kyle Cooper, managing director of research at Cyprus Energy LP. He said offshore oil production could resume within two to three days if there is no damage.

There is one obvious impact from Isaac: higher gas prices. The national average retail price for gasoline rose nearly 5 cents to $3.804 per gallon on Wednesday, according to AAA, Wright Express and the Oil Price Information Service. That's the biggest one-day jump in about 18 months. The price is up about 9 cents from a week ago and 19 cents from a year ago.

In other energy trading:

? Heating oil fell 0.46 cent to end at $3.1157 per gallon.

? Wholesale gasoline fell 2.58 cents to end at $3.1003 per gallon.

? Natural gas rose 2 cents to end at $2.634 per 1,000 cubic feet. The government estimated that nearly 72 percent of Gulf natural gas production has been suspended due to Isaac.

NEW YORK (AP) - Brett Favre shouldn't have to respond to some embarrassing claims about his personal life that two massage therapists are making in a lawsuit, his lawyers say.

The massage therapists say the New York Jets blacklisted them after they objected to suggestive messages the legendary quarterback allegedly sent to another woman. Among other things, they asked him to admit or deny he solicited women for sex trysts and sent explicit photos to a former Jets game hostess. The request was part of a procedural step in their 2011 lawsuit.

Favre's attorneys filed papers this week asking a court to say he doesn't have to answer. They say some of the requests are irrelevant and inappropriate, including a bid to get him to acknowledge that a lewd photo that appeared on a sports gossip website depicts his own anatomy.

"These requests clearly have absolutely nothing to do with this lawsuit and have been included only to harass and embarrass," attorney Sharon H. Stern and other Favre lawyers wrote.

The rest of the requests are "nonsensical" or too much in debate to ask him simply to admit them, his lawyers said.

The Jets and another defendant, a massage therapist who helped others get work with the team, filed similar objections this week.

The massage therapists' lawyer called the filings an effort to shield Favre from having to discuss his conduct.

"It's yet another attempt by the defendants, particularly Brett Favre, to avoid having to testify under oath in this matter," attorney Elizabeth Eilender said.

The Jets' lawyer declined to comment. Lawyers for Favre and the other defendant didn't immediately respond to phone and email messages Wednesday evening.

Massage therapists Shannon O'Toole and Christina Scavo say they were called to give massages at the Jets training camp and to various players individually, until they ran afoul of Favre.

During the 2008 preseason, the lawsuit alleges, the now-retired three-time NFL MVP sent another woman a text message asking to get together with her and Scavo, followed by another text saying, "I guess I have bad intentions."

After Scavo's husband asked Favre to apologize, she and O'Toole lost gigs with the Jets, the suit says. They are seeking unspecified damages.

The suit was filed five days after the NFL fined Favre $50,000 for not being forthright in an investigation into allegations that he sent bawdy text messages and photos to former Jets game hostess Jenn Sterger when they both worked for the team. During that investigation, media reports claimed Favre also had pursued massage therapists, but the NFL said it was unable to get enough information to decide whether the reports were substantiated.

The Jets have said O'Toole and Scavo worked for the team for a combined total of only five days over two years, making $2,300 in all, and were never guaranteed any ongoing work. The team wasn't told about the women's concerns and simply turned to other massage therapists after its training facility moved in 2008, Jets officials and lawyers said in court filings.

In court papers, Favre has denied the allegations and argued that if Scavo and O'Toole lost work, he wasn't responsible for it.

Favre retired from the NFL in 2010, after playing for 20 seasons, mostly with the Green Bay Packers. He is the league's all-time leader with 71,838 passing yards and 508 touchdowns, won a Super Bowl with the Packers in 1996, and holds the 297-game record for consecutive starts.

He is now helping coach the football team at Oak Grove High School in Hattiesburg, Miss., near his home.

Obama?s campaign pitches top five Romney ?falsehoods?

Just before 3:00 a.m. on Tuesday morning, President Barack Obama?s campaign released a list of the ?Top Five Falsehoods? that might lead Americans astray and cause them to vote for Republican presidential candidate Mitt Romney.

The first item on the list is Obama?s revealing July charge to business owners and?entrepreneurs?that ?you didn?t build that.?

Another three of five ?falsehoods? are Romney?s criticisms of Obama?s unpopular health care takeover, Obama?s July 12 welfare-to-work relaxation and Obamacare?s $719 billion cut to Medicare spending.

The fifth item is ?birtherism,? according to the campaign email, which alleged that ?Romney actually enlisted himself in this birther movement last week.?

Republicans will ?be using their primetime coverage this week to launch their same old attacks,? read the e-mail from Deputy Campaign Manager Stephanie Cutter. ?This will be the first time many folks are tuning into the election this year ? so we need to double down on our efforts to fight back?. [and] we put together the top five falsehoods to look out for this week.?

?Take a peek, and don?t be shy about passing them on,? she urged Obama campaign supporters.

The list suggests that Romney?s messages are worrying the Obama campaign.

Obama?s July 13 ?you didn?t build that? line is a frequent centerpiece in speeches by Romney and his running mate, Rep. Paul Ryan, as well as in the ads they?re running in swing states.?But ?Romney took the president?s words out of context in an attempt to imply that the president was somehow insulting small business owners ? rather than advocating for investments that help them succeed,? read Cutter?s e-mail.

Cutter?s message didn?t actually quote the president?s statement, which has reportedly damaged the president?s support among American?entrepreneurs.

In his impromptu statement, Obama told his Roanoke, Virginia audience, ?[L]ook, if you?ve been successful, you didn?t get there on your own.? You didn?t get there on your own.? I?m always struck by people who think, well, it must be because I was just so smart.? There are a lot of smart people out there.? It must be because I worked harder than everybody else.? Let me tell you something ? there are a whole bunch of hardworking people out there.?If you were successful, somebody along the line gave you some help.? There was a great teacher somewhere in your life.? Somebody helped to create this unbelievable American system that we have that allowed you to thrive.? Somebody invested in roads and bridges.??If you?ve got a business ? you didn?t build that.? Somebody else made that happen.?

The second item on Cutter?s list is Medicare, where Obama?s expected advantage has withered because of his decision to fund Obamacare with $719 billion in unpopular Medicare cuts.?Those cuts have allowed Romney and Ryan to woo retirees? votes with a promise to reverse the deep cuts in Medicare-related spending.

Cutter?s e-mail doesn?t mention the $719 billion cut, but instead charges that Romney is making a ?categorically false attack? before changing the subject to Romney?s long-term Medicare reform proposals.

Romney ?wants to turn Medicare into a voucher system? [and] would force new retirees to pay more out of pocket for services,? read the email.

The No. 3 item on the warning list is Romney?s argument that the popular 1996 uniform welfare-to-work rules are being gutted by a recent decision to allow states to design their own looser welfare-to-work rules. ?President Obama is a strong supporter of welfare-to-work programs and recently gave states flexibility to help move more people from assistance to employment as quickly as possible ? a policy that many Republican governors, including Romney himself, have requested,? read Cutter?s email.

The No. 4 item is Obamacare.

Many polls show a majority of the public is either hostile or suspicious of the far-reaching effort to give the federal government centralized control over health care practices and spending.?But Obamacare really protects the private sector health system while making sure ?insurance companies play by the rules,? read the Cutter e-mail.

?Romney has launched a myriad of false statements and distortions about the health care law? [but] Obamacare improves the private health care system, strengthens the insurance plan you currently have, reduces the deficit, and offers the largest middle-class tax cut for health care in history,? according to the e-mail.

The fifth ?falsehood,? Cutter charges, is ?birtherism.?

The email?s focus on Obama?s birthplace is likely intended to sway non-ideological voters away from Romney.?Cutter highlighted the issue, and used a recent Romney joke about his familiarity to Michigan voters to argue that Romney was spreading false rumors.

?Conspiracy theorists and members of the Republican Party continue to push this false and dangerous attack? [and] Romney actually enlisted himself in this birther movement last week: ?No one?s ever asked to see my birth certificate. They know that this is the place that we were born and raised,? he said.?

Since 2008, Obama and his allies have repeatedly highlighted the rumors about his birthplace to stigmatize critics. His online store, for example, sells several items carrying images of his birth certificate. The first three items on display at the online store cite the rumors, including the pitch for the first item, which is a ?Made in The USA Mug.?

?There?s really no way to make the conspiracy about President Obama?s birth certificate completely go away, so we might as well laugh at it ? and make sure as many people as possible are in on the joke,? reads the pitch.

Samsung reveals Galaxy Note II

Fresh off a legal battle with Apple, Samsung is announcing a new version of the Galaxy Note, an offbeat, oversized smartphone that's become a surprise hit.

Samsung, the world's largest maker of phones, is revealing the Galaxy Note II at a trade show in Berlin. The 5.5-inch screen is narrower but longer than on the first version. The processor is faster, and the software has been further adapted for the included stylus ? the phone's signature feature.

While Apple has been releasing a new smartphone model each year, Samsung makes several to target different types of customers. That includes low-end phones for price-conscious customers. As a result, Samsung has been selling more smartphones than Apple this year.

The Note runs on Google's Android operating system but isn't among the phones that Apple is asking a judge to ban from the U.S., after a jury in California ruled last week that some of Samsung's Android phones violated Apple patents. The jury awarded Apple $1 billion in damages in a high-profile case that could force Samsung and other Android phone makers to rethink their designs.

The Note is designed to work well with a stylus for jotting notes and drawing on a screen, while styluses for other devices tend to be an afterthought. The Note's large screen also makes the phone more like a tablet and more suitable for playing games and consuming content. Samsung started selling a tablet version of the Note this month.

Samsung says it has shipped 10 million first-generation Galaxy Notes in one year.

Samsung says the new phone will go on sale in Europe and Asia in October. It did not say when it would launch with a U.S. carrier.

Dr Geoffrey Newton, aged 81, died from mesothelioma

Geoffrey Newton had always prided himself on his DIY skills.

Even aged 81, he was fitting a new kitchen and bathroom in his home.

?Over the years he?d done everything from building a boat to converting an old school house into our home,? says his wife Pat, 82, a former GP.

?He was brilliant at DIY. Nothing was ever too much of a challenge.?

Unfortunately, it was this passion that most likely led to Mr Newton?s death in May.

He was suffering from mesothelioma ? cancer of the lining of the lungs ? caused by exposure to asbestos.

Experts say that even a few hours? exposure to the toxic fibres can be enough to trigger the condition later in life.

And a few hours was all it had taken for Mr Newton, a leading orthopaedic surgeon, to remove an old central heating boiler packed with white asbestos from his house in Burton-on-Trent.

?It was 37 years ago, but I still remember all the white dust that came out with it,? says Pat.

?At the time, it was known that brown and blue asbestos (there are three types) were dangerous, but not white, so we assumed the dust was harmless.

?But it?s the only occasion we can think of that Geoffrey was exposed to it, so that must have been the trigger.?

While asbestos has left a cruel legacy for families such as the Newtons, experts are warning it is still very much a risk, mainly due to thousands of homeowners who could unwittingly disturb asbestos while embarking on home renovations.

The number of people dying each year from mesothelioma has nearly quadrupled in the past 30 years.

The Department of Health estimates deaths will peak in 2016 because the danger of asbestos became widely known only in the? mid-Seventies, and the time lag between exposure and diagnosis is, typically, 30 to 40 years.

Crucially, with asbestos remaining in millions of buildings across the country, many of us are still exposing ourselves to asbestos without realising it, says Dr John Moore-Gillon, an honorary medical adviser to the British Lung Foundation (BLF).

?Many people think that because asbestos stopped being used in industry many years ago, it?s no longer an issue,? he says.

?The problem today is that people can disturb asbestos in their homes without realising it is there.

?They embark on DIY projects ? or hire a? few local lads to do some demolition work without an initial survey ? and unwittingly expose everyone to it.

?Cases will continue to rise if precautions aren?t taken.

?What is worrying is that we barely have the resources to treat the condition, so if numbers continue to rise then there could be a huge strain in terms of treating everyone.?

The BLF says asbestos was widely used in commercial buildings and homes until 1999, when it was banned, so any home built or refurbished before this date could contain asbestos.

?We don?t want to cause panic,? says Dr Moore-Gillon.

?It?s not the case that one fibre will kill you or that having a house with asbestos will put you?at risk. It?s disturbing the asbestos that?s the?problem.

?Usually, if it is found, the right thing is to seal it?away and leave it alone.

?If the area needs to be?demolished, then it can be ? but with appropriate precautions.?

Accordingly, the British Lung Foundation has launched a campaign, Take 5 To Stay Alive, urging the public to take five minutes to consider whether asbestos could be an issue before embarking on any?work.

Christine Winter, of the Independent Asbestos Training Providers, which champions safety and awareness when working with asbestos, adds: ?I am amazed at how many people have absolutely no knowledge of the danger they place themselves in when they start renovations.?

And, cautions the BLF, don?t assume trades-people know about asbestos and the risks. If you are the homeowner, you have a responsibility to protect them from exposure to fibres.

Asbestos is a naturally occurring fibrous mineral.

Large-scale mining during the late 19th century allowed industries such as construction and shipbuilding to take advantage of its affordability, sound absorption and fire and heat resistance.

It became most popular as a building material in the Fifties, finding its way into ceiling tiles, pipe insulation, boilers, sprayed coatings, water tanks, and floor and garage roof tiles.

The dangers of asbestos to lung health began to be established from the Forties, but only became widely known in the late Seventies.

Mesothelioma has a strong association with exposure to asbestos fibres, and is extremely rare in its absence.

The disease affects the lining of the lungs and is almost always fatal, with survival from point of diagnosis usually between six months and three years.

There were more than 2,300 deaths from mesothelioma in Britain in 2009 ? more than from cervical cancer or malignant melanoma ? and the incidence is still rising due to the 30 to 40-year time lag between exposure and disease development.?

Exposure to asbestos fibres can also cause lung cancer. It develops in the tubes that carry air in and out of the lungs, and can grow within the lungs and spread outside.

?Asbestos fibres are very small and easy to inhale, and once in the lungs they seem to alter the way in which cells multiply and divide,? says Dr Moore-Gillon.

?It?s probable that asbestos alters DNA and increases the likelihood of producing cells of abnormal structure and function. ?

Men account for 80?per cent of mesothelioma cases. It is less common in women because they don?t tend to work in industry.

Smoking increases the risk of developing an asbestos-related cancer by up to 75 times.

Symptoms of the disease include breathlessness, pains in the chest and a persistent cough.

?The overwhelming majority will not be signs of mesothelioma, but it?s always worth mentioning to your doctor if you have ? or suspect you may have ? come into contact with asbestos,? says Dr Moore-Gillon.

There is no cure, though early diagnosis can increase the possibility of being able to use surgery to tackle the cancer.

Other treatments include chemotherapy and radiotherapy, but these are largely to keep symptoms under control for as long as possible.

Geoffrey Newton lived 18 months after his diagnosis.

?It was all very quick,? says his widow Pat.

?He developed breathlessness, which turned out to be pleural effusion ? a build-up of fluid in the lungs. From there mesothelioma was diagnosed.

?He started off saying he wanted to book a train to Switzerland (to the Dignitas clinic), but then calmed down and did very well for 18 months after his diagnosis.

?He even insisted on fitting the kitchen and bathroom before he died. Even though he was frail, he got our daughter Sarah, who?s 37, to help with the heavy lifting.

?It was all incredibly bad luck. We have friends who worked as ships engineers and were heavily exposed to it, but they are fine.?

Many people who have been exposed unwittingly may seek compensation, but such cases are fraught legally, says Christine Winter.

?The problem lies in the proof of where the individual was exposed to asbestos, because of the long latency period before the consequences present.

?If work-related, the employer may no longer be trading or may not have had insurance for asbestos exposure.

?This will have a massive health impact in the future unless we can get the message across that the dangers of asbestos still exist.?

Someone else who knows all too well of its impact is Mavis Nye, from Whitstable, Kent.

In the early Sixties, her husband Ray was a shipwright in Chatham dockyards, and she would wash his clothes when he came home.

?They were always covered in asbestos dust ? we used to joke he looked like a snowman when he came through the door,? says Mavis, 71.

?We had no idea how lethal it was.?

Fed up of working in a dusty environment, Ray left the dockyard in 1963.

Years later, with knowledge of how lethal asbestos was, the couple feared for Ray?s health. But, in fact, it was Mavis who became unwell.

?We were on holiday in Spain in 2009 when I felt very tired and breathless walking up a hill that I?d normally have no problems with,? she says.

Back home, her GP arranged an immediate chest X-ray, and Mavis was called back to the hospital for scans.

?And then, boom ? I was told I had mesothelioma and given three months to live.

?I came home, arranged my funeral, threw out most of my clothes and bought new things for the house so Ray wouldn?t have to deal with it all.?

Mavis has survived three years, which she attributes to large doses of chemotherapy.

Her tumours have shrunk, and she can have further chemotherapy if they begin to grow again.

?It?s sometimes hard to breathe ? there?s a tightness across my chest ? but I?m still active,? she says.

Ray, 74, adds: ?Not a day goes by when I don?t wish it was the other way round.?

HOW TO PROTECT YOURSELF

  • Any home built or refurbished before
    2000 could contain asbestos. It can be found in ceiling and garage roof
    tiles, pipe lagging, boilers, sprayed coatings and cavity-wall
    insulation. Other common areas are around window frames.
  • To
    protect yourself during a DIY project, wear overalls, eye protection and
    a face mask ? especially if your job is likely to produce dust. But
    asbestos fibres are small enough to penetrate most masks, so never
    assume you?re safe. Dust can also settle on clothing, which could be a
    serious health risk to everyone you come into contact with.
  • Asbestos comes in all shapes, sizes and colours (blue, brown and white),
    which are found in many building products. But as it was often mixed
    with other materials, it can be hard to spot. The Health Safety
    Executive has produced an image gallery of typical asbestos-containing

  • Asbestos materials
    in good condition are not a health risk and should be fine if you leave
    them alone. Simply check their condition from time to time to ensure
    they haven?t started to deteriorate. If you have to remove asbestos,
    it?s essential you use a reputable, licensed contractor to handle and
    dispose of it properly.

Fittest thrive as they age | Health Magazine


Being fit at 50 seems to improve health related quality of life as people age, a large U.S. study concludes.

Unlike previous research that has looked at physical activity and healthy aging, the study in this week?s issue of the Archives of Internal Medicine zeroed in on a measurable fitness level.

Dr. Benjamin Willis of the Cooper Institute in Dallas and his colleagues used treadmill tests to assess the cardio-respiratory fitness of 14,726 healthy men and 3,944 healthy woman with an average age of 49 when the study began in 1970.

?In summary, midlife fitness was associated with a lower risk of common chronic health conditions in men and women older than 65 years enrolled in Medicare,? the study?s authors concluded.

The researchers assessed participants for eight chronic conditions until 2009:

  • Congestive heart failure.
  • Ischemic heart disease.
  • Stroke.
  • Diabetes mellitus.
  • Chronic obstructive pulmonary disease.
  • Chronic kidney disease.
  • Alzheimer disease.
  • Colon cancer.
  • Lung cancer.

Participants were divided into five groups based on their fitness levels.

Among men in the lowest fifth of fitness scores, the rate of chronic disease was 28 per cent compared with nearly 16 per cent among the fittest, the researchers found.

For women, the corresponding figures were 20 per cent versus 11 per cent.

The researchers relied on data from an administrative database rather than clinical diagnoses, which is one of the drawbacks of study.

Genetics matter

The findings were also based on participants who were wealthier, more educated and leaner compared with the average U.S. population.

Investigators took age, body mass index, blood pressure, cholesterol, smoking, blood glucose levels and alcohol intake into account.

In a commentary, Dr. Diane Bild of the National Heart, Lung and Blood Institute in Bethesda called the findings an ?excellent addition to the evidence supporting the contention that cardiorespiratory fitness helps people thrive.?

Bild also noted that fitness is a function of both exercise and genetics. Genetics likely plays a role in both longevity and disease avoidance, she said.

?Physical activity has a host of well-proven benefits, including effects on weight, cardiovascular disease risk factors, bone health and mental health,? Bild wrote.

?Resultant physical fitness may also help individuals maintain health and delay death and get our societal survival curves into the best shape: rectangular.?

The study was funded by the Cooper Institute, a nonprofit research group.
